The effect of the Spanish Law of Political Parties (LPP) on the attitude of the Basque Country population towards ETA: A dynamic modelling approach

Abstract In June 2002, the Spanish Government passed the “Law of Political Parties” (LPP) with the aim, among others, of preventing parties giving political support to terrorist organizations. This law affected the Basque nationalist party “Batasuna”, due to its proved relation with ETA. In this paper, taking data from the Euskobarometro (Basque Country survey) related to the attitude of the Basque population towards ETA, we propose a dynamic model for the pre-LPP scenario. This model will be extrapolated to the future in order to predict what would have happened to the attitude of the Basque population if the law had not been passed. The Egalitarian Quality of Lottocracy

Abstract. Recently, political models which employ lottery-selection instead of ballot voting have been proposed. Proponents argue that such  lottocratic models can improve the representation of the population and reduce undemocratic influences. In this paper, I argue that these proposals also satisfy the egalitarian requirement of democracy. Geneza Case Method i jej wpływ na kształt amerykańskiej filozofii prawa

Artykuł omawia Case Method – dominującą metodę edukacyjną stosowaną w amerykańskich szkołach prawa, która polega na nauczaniu prawa poprzez analizę orzeczeń sądowych, stworzoną w latach 70. XIX w. przez Christophusa Collumbusa Langdella. Langdell postrzegał prawo jako naukę, podobną do fizyki czy chemii, a więc jako uporządkowany system obiektywnej wiedzy. Stworzona przez niego metoda nauczania służyć miała przygotowaniu osób zajmujących się prawem w sposób naukowy. W artykule przedstawiona została koncepcja prawa Langdella, oraz wpływ, jaki jego metoda nauczania wywarła na nurty amerykańskiej filozofii prawa – klasyczną jurysprudencję oraz realizm prawniczy.

Electronic monitoring is a new solution in Polish penal law. It should be noted that the electronic monitoring was initiated in the United States of America by psychologist Ralph Schwitzgebel in 1964. In Poland the system of electronic monitoring appeared in a later period of time. One of the basic legislator’s purposes was to reduce overcrowding in prisons. The study aims to analyze a consequence of the annulment of the dismissal decision by the court, for reasons of lackluster or unlawfulness. According to art. 80 of the Labor Code, in the event of the finding of illegality and/or inadequacy of the dismissal decision, the court orders the cancellation of the unilateral act of dismissal. The purpose of this article is to analyse the differnt civil process of the Civil Procedure Law that can be used for the recovery of illegally occupied properties: eviction for precarious, injunction to recover possession and action action for the protection of registered property rights. Special attention is paid to the new procedure of rapid recovery of possession that has been created by Law 5/2018 amending the classic injunction to regain possession.

Czas na wytoczenie przez mężczyznę powództwa o zaprzeczenie ojcostwa lub o ustalenie bezskuteczności uznania ojcostwa jest krótki i wynosi 6 miesięcy. Ponadto po jego upłynięciu jedyną możliwością z perspektywy ojca jest wytoczenie powództwa przez prokuratora, który de facto nie musi się przychylić do wniosku mężczyzny i może odmówić tej czynności. The institution of the Real Audiencia in the kingdom of Sardinia since the 1560s is part of a wider process which saw the rise and development of royal supreme courts of justice in several European countries of the early modern period.
